Twitter Sued for Failure to Remove Infringing Photos per DMCA

On September 11, 2012, an artist named Christopher Boffoli, sued Twitter alleging copyright infringement after Twitter ignored a series of DMCA takedown requests sent by the artist. Boffoli is a full-time artist from Seattle who created the popular “Disparity Series,” consisting of photographs featuring miniature figures in funny poses on various types of food. Since his photographs went viral last year, he has spent quite a bit of his time lodging DMCA notices, sending takedown requests to individuals, and sites like Facebook, Pinterest, and Google. Even some of his draft images were stolen off a server and distributed without his consent.

Boffoli’s photographs are original and well done. And, I must say, very clever.
