Pinterest still does not comply with DMCA regardless of Amazon’s handling DMCA Notices
My last post about Pinterest generated a lot of interest about Pinterest’s failure to properly implement the DMCA. Since then, Pinterest has changed its TOU, AUP, and Privacy Policy, and its DMCA Policy, effective April 6, 2012. However, it has not changed its designated agent on file with the US Copyright Office. I am hoping that the form is simply yet to be processed by the Copyright Office.
Pinterest has announced that Amazon has agreed to handle Pinterest’s DMCA Notices. This is definitely a good arrangement for Pinterest. It is probably a good solution for Amazon as well since Amazon would also receive DMCA Notices about Pinterest because Amazon’s servers store the infringing images pinned to Pinterest.
Nevertheless, Pinterest still has not changed its designated agent with the Copyright Office as per the DMCA. So, even though Amazon may be handling the DMCA Notices, it still remains to be seen whether or not Pinterest qualifies for the DMCA safe harbor immunity.
